Deposit Reservation & Product Sales Terms and Conditions
1. General
These Terms and Conditions apply to online deposits and product purchases from Scootershop. They apply in addition to, and do not exclude or limit, rights that cannot be excluded under the Australian Consumer Law or other applicable law.
2. Motorcycle and scooter deposit reservations
2.1 What a deposit is
Paying a deposit reserves the motorcycle or scooter stock identified in your reservation, or your place in the order queue for the model and colour selected. It is not a purchase of the vehicle and does not create a contract to buy it.
A vehicle sale contract is formed only under the prescribed Vehicle Sale Contract when you have signed it, we have signed it or it has been signed for us by an authorised person, and we have notified you that we accept it. We will provide the proposed contract after we have the details needed to prepare it.
2.2 Before a vehicle sale contract is accepted
Until that Vehicle Sale Contract is accepted by us, you are not obliged to buy the vehicle and we are not obliged to supply it. We may stop offering a reserved in-stock vehicle to other buyers while the reservation remains open.
The deposit amount shown at checkout is the amount required to reserve stock. If a Vehicle Sale Contract is later accepted, the deposit will be credited against the total purchase price stated in that contract.
2.3 Price, availability and refund
Any vehicle price, delivery estimate, arrival estimate or availability shown before a Vehicle Sale Contract is accepted is indicative only. The total purchase price, delivery arrangements and any applicable statutory terms are those in the accepted Vehicle Sale Contract.
You may ask us to cancel a reservation at any time before the Vehicle Sale Contract is accepted. We will refund the deposit in full as soon as reasonably practicable. Once a Vehicle Sale Contract has been accepted, cancellation, refunds and any deposit handling are governed by that contract and applicable law.
3. Pricing and Payment
For ordinary product purchases, full payment must be made before a Product is released or handed over. Payment methods may be made available through approved payment systems. Any third-party finance or instalment service is a separate arrangement between the customer and that provider. We may correct an obvious pricing error before accepting an order, subject to your non-excludable legal rights.
4. Collection and Delivery
Products are generally collected in store. Delivery may be arranged where agreed. For a motorcycle or scooter sale, delivery arrangements and risk are governed by the accepted Vehicle Sale Contract and any agreed special conditions.
5. Ownership and Risk
Ownership of a Product does not pass until full payment has been received. For a motorcycle or scooter sale, ownership and risk are governed by the accepted Vehicle Sale Contract.
6. Returns and Refunds
Change-of-mind returns are not guaranteed and may be refused at our discretion, subject always to any rights the customer may have under applicable consumer law. Nothing in these Terms excludes, restricts, or modifies any rights or remedies available under the Australian Consumer Law or any other applicable law. If a Product is faulty, damaged, or otherwise not of acceptable quality, any remedies will be provided in accordance with law.
7. Product Condition
Customers are responsible for inspecting Products at the time of collection or delivery and should notify us promptly of any visible issues. Second-hand Products are sold in their current condition unless otherwise stated in writing.
8. Licensing Requirements
Where a Product requires a valid licence or other authorisation for use or ownership, the customer must provide the information and documents required by law and the accepted Vehicle Sale Contract before collection or delivery. We may refuse to release a Product where a legal or licensing requirement has not been met.
9. Liability
To the maximum extent permitted by law, the business is not liable for any indirect or consequential loss arising out of the sale of a Product. Where liability cannot be excluded by law, our liability is limited to the remedies required by law, including repair, replacement, or refund as applicable.
10. General
We may update these Terms from time to time. The version in force at the time of the deposit or purchase will apply to that transaction. If any part of these Terms is found to be unenforceable, that part will be read down or severed to the extent necessary, and the remaining provisions will continue in full force.
